Finsbury Park Removal Service Terms and Conditions

These Terms and Conditions apply to the provision of removal and associated services in and around Finsbury Park. By booking a service, you agree that you have read, understood and accept these Terms and Conditions. They govern the relationship between you and the service provider for all residential and commercial moves, transport, loading, unloading and related services.

Definitions

In these Terms and Conditions, the following expressions have the meanings set out below.

Customer means the individual, company or other organisation requesting and paying for the services.

Services means any removal, transport, loading, unloading, packing, unpacking, storage arrangement, or related work agreed with the Customer.

Goods means any personal effects, furniture, equipment, boxes or other property that the Customer asks to be moved, handled or transported.

Service Area means the primary locations in which the services are offered, including Finsbury Park and nearby districts.

Scope of Services

The provider offers removal and transport services within the Service Area and to and from other locations within the United Kingdom. Services generally include vehicle hire with driver, loading and unloading assistance, and transportation of Goods from the agreed collection address to the agreed delivery address.

Any additional services, such as packing, dismantling and reassembly of furniture, or arrangement of storage, must be requested at the time of booking and will be subject to additional charges. The provider reserves the right to refuse any service request at its sole discretion, particularly where it considers the work unsafe, unsuitable or beyond the scope of its standard operations.

Booking Process

All bookings are subject to availability and are not confirmed until the Customer has received explicit confirmation from the provider. Quotations may be given verbally or in writing following details provided by the Customer regarding the addresses, access conditions, size of the property, volume of Goods, and any special requirements.

The Customer is responsible for providing accurate and complete information at the time of enquiry and booking. This includes, without limitation, floor levels, lift availability, parking arrangements, access restrictions, the approximate number of items, and any particularly heavy, fragile or valuable Goods.

Any quotation is based on the information supplied and on normal access conditions. If the actual work differs from the information provided at the time of booking, the provider may adjust the price accordingly, and any additional time, labour, equipment or parking costs will be chargeable.

Bookings may require a deposit or full prepayment, depending on the nature of the service, the distance and the date. The Customer will be informed of any such requirement during the booking process.

Pricing and Quotations

Prices are usually calculated based on factors such as the number of operatives, size of vehicle, estimated duration, distance travelled and any additional services requested. Where an hourly rate is used, the chargeable time will normally run from arrival at the collection address until completion of unloading at the final delivery address.

Any quotation is valid for a limited period, which will be stated at the time it is given, and is subject to change if the Customer delays confirmation, alters the service requirement or if costs outside the provider's control increase. Quotations do not include duties, tolls, congestion charges, parking charges, fines or other third party costs unless explicitly stated.

The provider reserves the right to adjust prices where the job requires additional labour, specialist equipment, or takes longer than anticipated due to circumstances beyond its control, such as poor access, delays caused by the Customer, or waiting for keys.

Payments

Unless otherwise agreed in writing, payment is due on or before the day of the service. The provider may require payment in advance, particularly for larger moves, long distance journeys or where a specific time slot is reserved exclusively for the Customer.

Payment methods will be communicated to the Customer during the booking process. The Customer must ensure that cleared funds are available by the due time. If payment is not received as agreed, the provider may refuse to carry out the service, retain Goods in its possession, or suspend delivery until payment is made in full.

Where credit terms are offered to business Customers, invoices must be paid by the stated due date. The provider reserves the right to charge interest on late payments at the applicable statutory rate and to recover all reasonable costs of recovering overdue sums.

Customer Responsibilities

The Customer is responsible for ensuring that adequate and legal parking is available at both collection and delivery addresses. Any parking permits, visitor vouchers or temporary dispensations required must be arranged by the Customer in advance, unless specifically agreed otherwise. The Customer is liable for any parking penalties or fines incurred as a result of insufficient or unlawful parking instructions.

The Customer must ensure that access to the property is safe and suitable for the operatives and the vehicle. This includes clearing walkways, staircases and entrances of obstacles and informing the provider in advance of any access restrictions such as narrow doorways, low ceilings or internal steps.

The Customer is responsible for packing Goods securely, unless packing services have been specifically requested and paid for. Fragile items such as glass, china, electronics and artwork must be adequately protected. The provider will not be liable for damage arising from inadequate packing by the Customer.

The Customer must be present, or represented by an authorised person, at both collection and delivery addresses to direct the operatives, confirm items to be moved, and check that Goods are correctly loaded and unloaded.

Cancellations and Changes

The Customer may cancel or amend a booking by giving notice to the provider. Any cancellation or change is only effective once acknowledged by the provider. The following cancellation terms will apply unless otherwise agreed in writing.

If cancellation is made more than a specified minimum period before the scheduled start time, typically 48 hours, any deposit paid may be refunded or credited, subject to any reasonable administrative charges.

If cancellation is made within a short notice period before the scheduled start time, the provider may retain part or all of any deposit and may charge a cancellation fee to cover allocated resources and lost opportunity.

If the Customer is not present at the agreed time and place, or fails to provide access, parking or payment as agreed, this may be treated as a same day cancellation, and the full quoted amount may become due.

Requests to change dates, times, addresses or scope of work are subject to availability and may result in an adjusted price. Where changes reduce the size or duration of the job, the provider may apply a minimum charge.

Delays and Waiting Time

While the provider aims to attend appointments on time, arrival times are estimates and are not guaranteed. The provider will not be liable for delays caused by traffic, road closures, accidents, vehicle breakdowns, extreme weather or other events beyond its reasonable control. In such cases, the provider will make reasonable efforts to inform the Customer and to complete the service as soon as reasonably practicable.

Where waiting time arises due to circumstances within the Customer's control, such as delayed key release, incomplete packing, or lack of access, this time may be charged at the agreed hourly rate or an additional waiting fee as notified to the Customer.

Liability and Limitations

The provider will exercise reasonable care and skill in handling and transporting the Goods. However, its liability is subject to the following limitations.

The provider is not liable for loss or damage arising from inherent defects, pre existing damage, insufficient packing by the Customer, normal wear and tear, or the delicate nature of certain items such as glass, mirrors, artwork, antiques, plants or items of exceptionally high value unless these have been specifically declared and additional arrangements agreed.

Liability for any proven loss or damage to Goods caused by the provider's negligence or breach of duty will be limited to a reasonable cost of repair or replacement, subject to an overall cap per job. The applicable cap and any insurance arrangements may be notified to the Customer upon request or at the time of booking.

The provider will not be liable for any indirect or consequential losses, including loss of profit, loss of business, loss of data, emotional distress, or inconvenience, whether arising in contract, tort or otherwise.

The Customer must inspect the Goods promptly upon delivery and notify the provider of any visible loss or damage before the operatives leave the delivery address when reasonably possible. Any later claims must be notified within a reasonable period and supported by evidence. Failure to do so may limit the ability to investigate and may affect any potential remedy.

Excluded and Restricted Items

The provider may refuse to transport certain items, including but not limited to hazardous materials, illegal substances, weapons, explosives, flammable liquids, gas cylinders, perishable goods, live animals, or any items that could pose a risk to health, safety or property.

If the Customer includes any such items without disclosing them, the Customer will be solely responsible for all resulting loss, damage, claims, penalties or costs, and the provider may dispose of such items without compensation.

Waste Regulations and Disposal

The provider operates in line with applicable waste and environmental regulations. The removal of unwanted items, rubbish or waste is only offered where specifically agreed in advance. In such cases, the provider will transport the waste to an appropriate facility in accordance with relevant regulations.

The Customer must not request or permit the provider to dispose of waste illegally, such as by fly tipping or leaving items in unauthorised locations. The Customer is responsible for ensuring that any items presented for disposal are lawfully theirs to discard.

Certain items require special handling or disposal, such as electrical equipment, mattresses, construction debris or hazardous materials. Additional charges may apply for these items, and the provider may refuse to collect them if they are not properly identified in advance.

The Customer acknowledges that failure to comply with waste regulations can result in fines or enforcement action. Where such issues arise due to the Customer's instructions or omissions, the Customer will indemnify the provider for any resulting penalties, costs or damages.

Insurance

The provider will maintain appropriate vehicle and public liability insurance as required by law. Additional transit or Goods insurance may be available or recommended depending on the value and nature of the Goods. The Customer is encouraged to consider arranging separate insurance for valuable or irreplaceable items, as the provider's liability is limited.

Details of available insurance cover, exclusions and limits can be supplied to the Customer upon request. It is the Customer's responsibility to review such information and decide whether it is adequate for their needs.

Complaints and Disputes

If the Customer is dissatisfied with any aspect of the service, they should raise the issue as soon as possible with a representative of the provider, ideally on the day of the move, so that immediate steps can be taken to address the concern where possible.

For more complex issues, the Customer may submit a written complaint describing the problem, the date of service and the outcome sought. The provider will investigate the complaint and respond within a reasonable time, usually aiming to provide an initial response within 14 days.

Both parties agree to act in good faith to resolve any disputes arising under these Terms and Conditions. If agreement cannot be reached through direct communication, either party may explore alternative dispute resolution methods or take legal action in accordance with the governing law clause.

Privacy and Data Protection

The provider will collect and use personal data such as names, addresses and contact details for the purpose of handling enquiries, confirming bookings, delivering services and fulfilling legal obligations. Personal data will be processed in accordance with applicable data protection legislation.

The provider will take reasonable steps to keep personal information secure and will not sell or disclose such data to third parties except where necessary for the performance of the contract, for lawful compliance, or with the Customer's consent.

Governing Law and Jurisdiction

These Terms and Conditions, and any disputes or claims arising from or in connection with them or their subject matter, shall be governed by and construed in accordance with the law of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

General Provisions

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be deemed amended to achieve as nearly as possible the same economic effect as the original provision, and the remaining provisions shall continue in full force and effect.

No waiver by the provider of any breach of these Terms and Conditions shall be considered a waiver of any subsequent breach of the same or any other provision. No failure or delay by the provider in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that or any other right or remedy.

The Customer may not transfer or assign their rights or obligations under these Terms and Conditions without the prior written consent of the provider. The provider may assign or subcontract its rights and obligations where necessary for operational purposes, provided that this does not reduce the level of service to the Customer.

These Terms and Conditions constitute the entire agreement between the parties in relation to the services and supersede any prior understandings, representations or agreements, whether written or oral. Any variation to these Terms and Conditions will only be effective if agreed in writing by an authorised representative of the provider.
